Research on the Visual Distinctiveness of iPhone Mobile Phones

Company overview

The iPhone is a series of smartphones developed by Apple Inc. in the United States, running its proprietary iOS operating system. First launched in 2007, the iPhone quickly gained popularity worldwide due to its smooth operating system, minimalist design, and exceptional user experience, establishing itself as one of the leading brands in the smartphone market.

Research background

Recently, Apple Inc. has faced a lawsuit from a manufacturer alleging that several iPhone models infringe upon the plaintiff's design patent (referred to as the '113 Patent'). To respond to this legal action and provide credible data support for the case, Apple commissioned Fangda Law Firm to conduct consumer research. The objective is to evaluate the general public's ability to distinguish between iPhone mobile phones and the '113 Patent' design, identifying differences and similarities in visual design, thereby providing critical evidence for the litigation.

Research scope

In May 2020, CEIDEA Research was commissioned by Fangda Law Firm to collect data through a questionnaire survey targeting potential consumers. The primary focus of the research was to assess consumers' ability to identify and differentiate between currently available iPhone models and the '113 Patent' design. To ensure the accuracy and impartiality of the data, a notary public was present throughout the research process to provide on-site certification, guaranteeing the legality and reliability of the data collection. This series of studies aims to evaluate, from the perspective of ordinary consumers, the degree of visual similarity between the iPhone design and the '113 Patent' design, providing authentic market insights for the legal case.

Expected outcomes

Through this research, Apple will obtain objective data on the differences between the iPhone's design and the '113 Patent' design. These findings not only serve as strong evidence in the legal case but also help Apple better understand consumer perceptions and preferences regarding design aesthetics. The final report provides crucial support for the company's legal victory and offers valuable data for future similar litigation, helping Apple maintain its leadership position in the market.
